Welcome to Pixoza.art ("Platform," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our AI-powered image generation and editing platform, including all features, services, and content.

By accessing or using Pixoza.art, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our services.

2. Eligibility

You must meet the following requirements to use our service:

• Be at least 13 years old (or 16 in some jurisdictions)
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using our services under applicable laws
• Provide accurate and complete registration information

If you are under 18, you represent that you have your parent or guardian's permission to use the Platform.

3. Account Registration and Security

3.1 Account Creation

You may register for an account using email/password or through third-party authentication providers (Google, GitHub). You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Responsibilities

• Provide accurate, current, and complete information
• Maintain the security of your password
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account
• Not share your account with others

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason at our sole discretion.

4. Service Description

Pixoza.art provides the following services:

• AI-powered image generation from text prompts
• Background removal and image editing tools
• Portrait and photo enhancement features
• Custom AI model training (premium features)
• Image storage and gallery management

We may modify, suspend, or discontinue any aspect of the Platform at any time without notice.

5. Credit System and Pricing

5.1 Credits

Our platform operates on a credit-based system. Each action (image generation, editing, etc.) consumes a specific number of credits. Credit costs are displayed before each action.

5.2 Free Trial

• New users receive 2 free trial credits upon registration
• Trial credits are limited to one per device/user
• We use device fingerprinting to prevent abuse
• Trial credits do not expire unless the account is deleted

5.3 Paid Plans

We offer several pricing options:

• One-Time Purchases: Buy credit packages as needed
• Subscriptions: Monthly or annual plans with recurring credits
• Custom Plans: Enterprise solutions for high-volume users

5.4 Pricing Changes

We reserve the right to modify pricing at any time. Changes to subscription plans will be communicated 30 days in advance and will apply at the next billing cycle.

5.5 Credit Expiration

• One-time purchase credits do not expire
• Subscription credits may expire at the end of the billing period (plan-dependent)
• Unused credits are non-refundable

6. Payment and Billing

6.1 Payment Processing

All payments are processed securely through Stripe. We do not store your full payment card details. By providing payment information, you authorize us to charge your payment method.

6.2 Subscriptions

• Subscriptions automatically renew unless canceled
• You will be charged at the beginning of each billing cycle
• Cancel anytime through your account settings
• Cancellation takes effect at the end of the current billing period

6.3 Refund Policy

Due to the nature of digital services, all sales are final. We do not offer refunds for purchased credits or subscriptions, except as required by law or at our sole discretion in cases of service failure.

6.4 Taxes

You are responsible for any applicable taxes. Prices displayed may not include taxes, which will be calculated at checkout based on your location.

7. Acceptable Use Policy

7.1 Prohibited Content

You may not use our Platform to create, upload, or generate:

• Illegal, harmful, or violent content
• Child sexual abuse material (CSAM) or child exploitation content
• Non-consensual intimate images or deepfakes
• Content that violates intellectual property rights
• Hate speech, discrimination, or harassment
• Spam, malware, or phishing content
• Content promoting illegal activities
• Misleading or fraudulent content

7.2 Prohibited Activities

• Circumvent or attempt to circumvent our credit system
• Create multiple accounts to abuse free trials
• Reverse engineer, decompile, or attempt to extract our AI models
• Use automated tools (bots, scrapers) without authorization
• Overload or interfere with our systems or networks
• Impersonate others or misrepresent your affiliation
• Resell or redistribute our services without permission

7.3 Content Moderation

We employ automated and manual content moderation. We reserve the right to remove any content that violates these Terms and to report illegal content to authorities.

8. Intellectual Property Rights

8.1 Your Content

You retain ownership of images you generate using our Platform. By using our service, you grant us a limited license to:

• Store and process your content to provide our services
• Use anonymous, aggregated data to improve our AI models
• Display your content in your gallery and portfolio (if you choose to make it public)

8.2 Our Platform

All rights, title, and interest in the Platform, including our AI models, algorithms, software, design, and trademarks, are and will remain our exclusive property. These Terms do not grant you any rights to our intellectual property except as explicitly stated.

8.3 Third-Party Content

You are responsible for ensuring you have the necessary rights to any content you upload or use as input. You must not use our Platform to infringe on others' intellectual property rights.

8.4 Commercial Use

You may use images generated on our Platform for commercial purposes, subject to any restrictions in your subscription plan. You are responsible for ensuring your commercial use complies with applicable laws.

11. Disclaimers and Warranties

11.1 Service Availability

Our Platform is provided "as is" and "as available." We do not guarantee uninterrupted, error-free, or secure access. We may experience downtime for maintenance, updates, or technical issues.

11.2 Warranty Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL MEET YOUR REQUIREMENTS OR THAT DEFECTS WILL BE CORRECTED.

11.3 Third-Party Services

We integrate with third-party services (payment processors, authentication providers, AI models). We are not responsible for their availability, performance, or policies.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIXOZA.ART AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Indirect, incidental, consequential, special, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions or data loss
• Unauthorized access to your account or content
• Errors or inaccuracies in AI-generated content

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify, defend, and hold harmless Pixoza.art and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any laws or third-party rights
• Content you create, upload, or share

14. Dispute Resolution

14.1 Informal Resolution

Before filing a claim, you agree to contact us at support@pixoza.art to resolve the dispute informally. We will attempt to resolve the matter within 30 days.

14.2 Arbitration Agreement

If informal resolution fails, disputes shall be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if they qualify.

14.3 Class Action Waiver

YOU AND PIXOZA.ART AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

15. Governing Law
